4. The Vyalure Atelier Information
If you apply to or participate in The Vyalure Atelier, we may collect information such as name and contact information, shipping information, age or eligibility confirmation, skin type, skin sensitivity level, skin concerns, skin goals, product preferences, information about skincare products or prescription skincare products you voluntarily disclose, and product usage feedback.
We may also collect information about product application, comfort, scent experience, texture, finish, visible impressions, survey responses, product experience ratings, before-and-after impressions if voluntarily submitted, photos, videos, testimonials, consent forms, releases, survey acknowledgments, and communication history.
The Vyalure Atelier is intended for participants who are 18 years of age or older.
5. Sensitive Personal Information
Some information you voluntarily provide may be considered sensitive under certain privacy laws. This may include information related to skin sensitivity, skin concerns, allergies or reactions you choose to disclose, prescription skincare use, racial or ethnic background if voluntarily provided, or other information protected under applicable law.

Vyalure is not a healthcare provider and does not provide medical diagnosis, medical treatment, or medical advice through our Services, products, surveys, reviews, or The Vyalure Atelier.

Vyalure uses Personal Information for business, operational, legal, customer experience, and product development purposes, including to operate, maintain, and improve our Services; process, fulfill, ship, deliver, and manage orders; process payments, refunds, cancellations, returns, exchanges, gift cards, discounts, promotions, and subscriptions where applicable; create, maintain, secure, and support customer accounts; verify identity; prevent fraud and security incidents; communicate with you; and provide customer support.

We currently use Hoppy Cookie for cookie consent management. We may also use Shopify analytics, Google Analytics, Meta Pixel, Google Ads, and similar tools. Vyalure does not sell Personal Information for money.

11. Email and SMS Communications
If you sign up for email marketing, we may use your email address to send product updates, launch information, promotions, educational content, review requests, event information, and other Vyalure communications.
We currently use Shopify Email and may use another email marketing provider such as Omnisend, Klaviyo, or a similar platform. We may update our providers as Vyalure grows.
You may unsubscribe from marketing emails at any time by using the unsubscribe link in the email or by contacting us.
If you sign up for SMS communications, we may use Twilio or a related provider to send messages where permitted by law and with consent where required. You may opt out of SMS messages by following the instructions in the message, such as replying STOP, or by contacting us.
Transactional communications, such as order confirmations, shipping updates, account notices, customer service responses, policy updates, privacy responses, security messages, or legally required notices, may still be sent even if you unsubscribe from marketing communications.
12. Product Reviews, Testimonials, and Customer Content
We use Reviews.io and may use similar review tools to request, collect, verify, display, and manage product reviews.
If you submit a review, rating, testimonial, photo, video, or other content, we may display that content on our website, product pages, review widgets, social media, marketing materials, emails, advertisements, or other Vyalure channels, subject to applicable law and any permissions or terms connected to the submission.
Reviews may include your name, display name, rating, review content, product purchased, verification status, photo or video content, and other information you choose to provide.
When you submit public-facing content, you should avoid including information you do not want displayed publicly. We may moderate, remove, or decline to publish content that does not align with our review standards, legal obligations, or customer experience standards.
13. The Vyalure Atelier
The Vyalure Atelier is a consumer-informed product evaluation program designed to gather feedback before broader product release or as part of product development, product refinement, product education, and customer experience evaluation.
The Vyalure Atelier is intended for individuals who are 18 years of age or older.
If you apply to or participate in The Vyalure Atelier, we may use your information to review applications, determine eligibility, select participants, ship products or materials, communicate instructions, collect survey responses and feedback, evaluate product experience, review information you voluntarily disclose about skincare products or prescription skincare products, understand customer perception, support product development, develop product claims or statistics where appropriate, and maintain business, product evaluation, and consent records.
Atelier feedback may be used for research and development, quality review, product refinement, marketing insights, website content, product education, claims substantiation, and customer experience improvement, subject to applicable law and the permissions, releases, or consent forms connected to your participation.
Participation in The Vyalure Atelier may involve separate consent forms, release language, survey acknowledgments, or program-specific notices. If there is a conflict between this Privacy Policy and a specific Atelier consent or release, the more specific notice will apply to that program activity.
14. How We Disclose Personal Information
We may disclose Personal Information to service providers, processors, contractors, and business partners that help us operate Vyalure and provide our Services. These may include Shopify and ecommerce service providers; Shopify Payments, Shop Pay, PayPal, Afterpay, Klarna, Apple Pay, Google Pay, Square, and other payment providers; fraud prevention and security providers; shipping carriers and fulfillment partners; email and SMS providers; Reviews.io and review management platforms; customer service tools and communications providers; cookie consent and privacy tools, including Hoppy Cookie; analytics providers, including Shopify analytics and Google Analytics; advertising and marketing platforms, including Google Ads and Meta Pixel where enabled; survey and form providers, including Fillout or similar tools; Airtable or similar data organization tools; Microsoft 365 and business productivity tools; Twilio, Amazon Connect, and phone, IVR, SMS, call routing, or call recording providers; professional advisors; and IT, hosting, security, storage, and operational service providers.
These providers may process Personal Information on our behalf or as otherwise permitted by their terms, their role, and applicable law.
Where applicable, we may disclose certain website, device, cookie, or interaction data to advertising, analytics, or marketing partners to measure performance, understand customer behavior, support marketing, and improve the customer experience. Where required by law, we provide opt-out rights.

- Order, transaction, payment status, tax, and accounting records: generally retained for 7 years, unless a longer period is required for legal, tax, audit, product safety, dispute, or business purposes.
- Customer account information: retained while the account is active and for a reasonable period after account closure, unless deletion is requested and no legal exception applies.
- Customer support records: generally retained for up to 3 years, unless needed longer for disputes, quality review, safety, compliance, or business records.
- Call recordings: generally retained for up to 2 years, unless needed longer for quality assurance, compliance, security, disputes, claims, or legal purposes.
- Marketing records: retained until you unsubscribe, withdraw consent, or request deletion, subject to suppression-list retention needed to honor opt-out requests.
- SMS consent and opt-out records: retained as needed to document consent, opt-out status, compliance, and messaging history.
- Product reviews and testimonials: retained while the content is displayed and for a reasonable period afterward for business, verification, legal, or recordkeeping purposes.
- The Vyalure Atelier applications, surveys, feedback, photos, releases, and product evaluation records: generally retained for up to 6 years after the relevant product evaluation, publication, claim support, or product development use, unless a longer period is needed for product safety, research integrity, consent records, legal obligations, or business purposes.
- Privacy request records: generally retained for at least 3 years to document request handling, verification, response, completion, appeal, and compliance history.
- Security, fraud, and website logs: retained for a reasonable period based on security, fraud prevention, technical, analytics, and legal needs.
When Personal Information is no longer needed, we may delete, de-identify, aggregate, or archive it in accordance with applicable law and business needs.

Vyalure products may be purchased by adults for use by individuals ages 13 and older where appropriate, but we do not intentionally market to minors and The Vyalure Atelier is intended only for participants who are 18 years of age or older.
